In June 2023 the Legislature passed HB 1489, designating unincorporated Brevard south of the Town of Melbourne Beach down to Sebastian Inlet — the South Beaches — an Area of Critical State Concern effective July 1, 2023, and state agencies now take part in reviewing development applications and policy changes inside that boundary. That matters beyond permitting, because Florida’s vacation-rental preemption at s. 509.032(7), F.S. carries an express carve-out at subsection (7)(c) for areas of critical state concern. Whether your parcel is inside that line, in one of the sixteen municipalities, or in unincorporated mainland Brevard changes which rulebook reaches it.
What Brevard County rents for right now
RentCafe’s countywide number is built only from apartment buildings with 50 or more units, and in Brevard that inventory sits almost entirely in the mainland Melbourne, Viera and Palm Bay corridor — it captures very little of the barrier island from Cape Canaveral south to Melbourne Beach, where a large share of the rental stock is older beachside condominium and single-family product. Zumper’s two largest-city medians disagree with each other at every bedroom count, with Melbourne running above Palm Bay, so a single countywide average papers over both the beachside-versus-mainland split and the north-county Titusville market. The four-bedroom band is assembled from two city-level “4+” buckets that blend four-, five- and six-bedroom houses, so treat it as the softest number on this page.

Your address decides your rulebook, and the barrier island is not the mainland
Brevard runs roughly 72 miles north to south along the Atlantic, and almost every operating decision an owner makes here tracks that geography. The mainland corridor — Titusville, Cocoa, Rockledge, Viera, Melbourne, West Melbourne and Palm Bay — holds the county’s conventional rental stock and nearly all of the institutional apartment inventory that feeds published rent data. The barrier island, running from Cape Canaveral and Cocoa Beach south through Satellite Beach, Indian Harbour Beach, Indialantic and Melbourne Beach to the inlet, is a structurally different market: older construction, far more condominium and association ownership, and a wind and coastal flood exposure profile the mainland does not share. Between them sit the Indian River Lagoon and the Banana River, which drive water-quality policy that now shows up in septic, stormwater and shoreline rules attached to individual parcels.
The regulatory picture sharpened in 2023. Brevard County states that the Area of Critical State Concern designation does not disturb zoning or land use already in effect before July 1, 2023, but it does commit the county to a Comprehensive Plan appendix and follow-on Land Development Regulations organised around shoreline hardening and sea turtle protection, Indian River Lagoon water quality, and nutrient loading from septic and wastewater systems — with those regulations to be adopted within a year of the updated plan. Layered on top is the state framework: s. 509.032(7), F.S. bars a local law or ordinance from prohibiting vacation rentals or regulating their duration or frequency, but that bar does not apply to ordinances adopted on or before June 1, 2011, and subsection (7)(c) sets aside separate treatment for areas of critical state concern. Brevard is one of the few Florida counties where both halves of that statute are live at the same time on the same coastline.
What that means if you own here: Confirm your parcel’s jurisdiction before you assume anything about permitted use — unincorporated Brevard, one of the sixteen incorporated cities and towns, and the South Beaches critical-concern boundary are three different answers, and a Cocoa Beach address and a Melbourne Beach address are not governed by the same body. If you are underwriting any short-stay use, get your parcel’s specific zoning classification confirmed in writing by Planning and Zoning at (321) 633-2070 rather than relying on what a neighbour is doing; Brevard’s resort-dwelling provisions live inside the county Land Development Regulations rather than on a public web page, and the critical-concern carve-out may reach your address. For anything on the island or in a coastal flood zone, price the floodplain review into your renovation scope before you commit to it, because the federal substantial-improvement threshold is measured against the market value of the structure and a mid-sized kitchen-and-bath project on an older beachside house can cross it faster than owners expect.

Mainland corridor and barrier island are two markets
Titusville, Cocoa, Rockledge, Viera, Melbourne and Palm Bay carry the county’s apartment inventory and most of its post-1990 single-family rental stock. The island carries older construction, heavy condominium and association ownership, and a different insurance and maintenance load. A countywide rent figure describes the first far better than the second.
The 2023 critical-concern overlay
Unincorporated Brevard from south of Melbourne Beach to Sebastian Inlet now sits in an Area of Critical State Concern, with state agencies participating in review of development applications, public infrastructure projects and policy changes. The county has said pre-July 2023 zoning and land use are undisturbed, but new Land Development Regulations are to follow the updated plan.
Flood exposure and the substantial improvement threshold
Under the NFIP, once work on a structure is classed as substantial improvement — measured at 50 percent of the market value of the structure — the building must be brought into compliance with current flood requirements, which on a coastal parcel can mean elevation. Whether Brevard measures that per permit or accumulates it across permits over a set period is set by the county’s own flood ordinance; confirm it with the county before scoping a renovation.
Aerospace and port payroll set the demand floor
Kennedy Space Center accounts for roughly 15,000 contractors and civil servants, Brevard Public Schools around 9,500 employees, and L3Harris Technologies about 7,000 private-sector workers, alongside Health First and Port Canaveral cruise operations. That employment base is concentrated on the mainland, which is where the steadiest long-term tenant demand sits.

- Does the Area of Critical State Concern designation change what I can do with a rental I already own on the South Beaches?
- Brevard County has stated that the new plan and regulations do not affect zoning or land use that was in effect within the area before July 1, 2023. What does change is process: state agencies participate in reviewing development applications, public infrastructure projects and policy changes inside the boundary, and the county is committed to adopting follow-on Land Development Regulations after its Comprehensive Plan appendix is updated. If you are planning anything beyond routine maintenance, confirm current status with Planning and Zoning before you file.
- Is my Cocoa Beach condo governed by the county’s short-term rental rules?
- No. Cocoa Beach is an incorporated municipality with its own code, and Brevard’s county land development regulations apply in unincorporated areas. On top of the municipal code, a condominium association’s recorded declaration and rules commonly set minimum lease terms and approval requirements that are stricter than anything in the public code, and those are enforceable against you as owner. Check the municipal code and your declaration together, not one or the other.
- How much renovation can I do on an older beachside house before flood rules force an elevation?
- The federal trigger is substantial improvement, set at 50 percent of the market value of the structure, and crossing it requires the building to be brought into compliance with current flood construction requirements. The part that varies locally is the accounting: some Florida communities evaluate each permit on its own, and others add permits together over a defined period. We could not verify from a primary source which method Brevard applies, so treat that as an open question to confirm with the county’s floodplain administrator before you scope work, not after.
- Does Brevard have its own landlord-tenant rules I need to follow?
- Residential landlord-tenant law in Florida is set at state level under Chapter 83, Part II, Florida Statutes — deposit handling and notice, required notices before termination, access rights and the eviction process are statewide and do not change from county to county. What is genuinely local in Brevard is land use, zoning, code compliance, floodplain administration and whatever the relevant municipality or association imposes. Do not let a county-level article convince you that the tenancy rules themselves differ here.
