Flagler is effectively one city and a rim around it. ITT Community Development Corporation began platting in 1969 with a plan for roughly 48,000 homesites on about 42,000 acres and 23 miles of saltwater canals, and the city that grew on that grid — Palm Coast, incorporated December 31, 1999 — now holds most of the county's population. Two separate short-term rental registries run side by side as a result: the county's certificate for unincorporated property east of US 1, and Palm Coast's own registration under Ordinance 2025-01.

What Flagler County rents for right now

Flagler's published averages are dominated by a small set of larger apartment communities, nearly all of them in Palm Coast, while the county's actual rental inventory is overwhelmingly single-family houses sitting on the ITT lot grid. County-level and Palm Coast-level figures for the same bedroom count can sit hundreds of dollars apart because they are measuring different buildings, not different markets. Flagler Beach and the A1A Hammock corridor are a third product again, and neither published series describes them well.

Your septic permit can cap your occupancy before your bedroom count does

Flagler County's rules sit in Land Development Code Section 3.06.14, adopted as Ordinance No. 2015-02 on February 19, 2015 and amended by Ordinance 2015-05 and Ordinance 2016-01. They reach single-family and two-family dwellings in unincorporated Flagler and expressly do not reach multifamily buildings of three or more units, full-time owner-occupied dwellings, or unincorporated areas west of US Highway 1. The occupancy calculation is the distinctive part: maximum occupancy is whichever is less of one person per 150 gross square feet of conditioned living space, the septic permit capacity where applicable, or two persons per bedroom plus two additional persons in common areas — then hard-capped at ten occupants in R-1 through R/C districts and sixteen in others. Bedroom count alone does not set your number. Certificates require an inspection before issuance and annual re-inspections after, violations must be corrected within 30 days, inspection no-shows carry a fee and three failed attempts lead to denial or enforcement. Renewal applications go in no sooner than August 1 and no later than October 1, with all inspections passed and full compliance by December 31. Posted quiet hours run 10:00 p.m. to 8:00 a.m., trash storage runs at one container of at least 35 gallons per four transient occupants, and off-street parking runs at one space per three occupants with on-street parking prohibited. Properties lawfully operating before February 19, 2015 received a stepped-down vesting schedule — fourteen occupants, then twelve, then the standard limits — and that vesting is lost when the property sells. The county's published application fees are $400 initial, $200 renewal, $50 transfer and $50 modification.

Inside Palm Coast the rules are different and newer. Ordinance 2025-01 was adopted January 7, 2025 with registration in effect from early March 2025. It defines a short-term vacation rental as a unit rented to guests more than three times in a calendar year for periods of less than thirty days, and it regulates impacts rather than duration or frequency. Registration requires a compliant sample rental agreement, a designated responsible party, city and county business tax receipts, a Florida Department of Revenue tourist development tax certificate, a DBPR transient public lodging licence and an executed affidavit including a background check acknowledgement. Occupancy is two transient occupants per sleeping room or habitable space to a maximum of ten, with children three and under excluded. The responsible party must be available 24/7 by phone, respond within two hours to reported issues, monitor compliance weekly and accept service of violations. Parking is driveway-only, with street, sidewalk, swale and right-of-way parking prohibited and no recreational vehicles, boats or trailers in front of the house. The city states plainly that these requirements apply only to short-term rentals and that long-term rental properties are not required to register. Palm Coast also carries a CRS Class 4 flood rating, worth up to a 30% NFIP discount, a level the city says fewer than fifteen communities nationally hold.

What that means if you own here: before you advertise any sleeping capacity on an unincorporated Flagler parcel, pull the onsite sewage treatment permit and find its rated capacity, because if that number is lower than two-per-bedroom-plus-two or the 150-square-foot calculation, the septic rating is your legal maximum and the county will enforce the lesser figure. Calendar August 1, October 1 and December 31 as hard dates rather than reminders — a missed inspection cycle is the ordinary way a certificate lapses here, and three failed inspection attempts escalate to denial. If the property is inside Palm Coast, register with the city instead and name a responsible party who can genuinely take a call at 2 a.m. and be on site inside two hours, because that standard is written into the ordinance rather than implied. If the parcel is unincorporated and west of US 1, the county certificate requirement does not reach it at all — confirm the side of the highway, then confirm the city limit, and do both from the parcel record.

The septic permit can be your occupancy cap

Unincorporated Flagler sets maximum occupancy at whichever is less of three tests: one person per 150 gross square feet of conditioned living space, the septic permit capacity where applicable, or two persons per bedroom plus two in common areas. A ten-person ceiling applies in R-1 through R/C and sixteen elsewhere. A four-bedroom house with an undersized onsite sewage permit is capped by the permit, not the bedrooms.

Flagler County issues a Short-Term Vacation Rental Certificate for unincorporated single-family and two-family dwellings, excluding multifamily of three or more units, full-time owner-occupied homes and unincorporated areas west of US Highway 1. Palm Coast runs its own separate registration under Ordinance 2025-01. A property falls under one or the other, never both — and getting that wrong means registering with the wrong government.

The county renewal calendar is unforgiving

Renewal applications go in no sooner than August 1 and no later than October 1, and all inspections must be passed and compliance complete by December 31. Initial inspection precedes issuance, annual re-inspections follow, violations carry a 30-day correction window, inspection no-shows carry a fee, and three failed attempts trigger denial or enforcement action. This is a calendar discipline problem more than a paperwork problem.

A canal city with a rare flood rating

The original ITT plan carried 23 miles of saltwater canals through what is now Palm Coast, and the city holds a CRS Class 4 rating worth up to a 30% NFIP discount. Exposure is real: the county's own vulnerability assessment records storm surge damage to A1A in Flagler Beach from Hurricane Nicole and flags Palm Coast canal-front property as potentially affected by tidal flooding under 2070 intermediate-high sea level rise scenarios.

No — these are two separate programs for two separate jurisdictions, and a property falls under one of them. The county certificate covers unincorporated single-family and two-family dwellings east of US 1; Palm Coast's Ordinance 2025-01 registration covers property inside the city limits. Confirm the city boundary from the parcel record rather than the neighborhood name, because Palm Coast's boundary is irregular and the ITT grid crosses it.
Do I have to register a long-term rental with Palm Coast?
No. The city states directly that its registration requirements apply only to short-term rentals and that long-term rental properties are not required to register. Ordinance 2025-01 defines a short-term vacation rental as a unit rented to guests more than three times in a calendar year for periods of less than thirty days.
